Castel de Cantobre Lease Agreement For Gîte Hire

Terminology: The use of the words "us", "we" and "our" refers to the owners of Castel de Cantobre or their representatives.
The use of the words "you" or "your" refers to the tenant and the tenant's group including any guests or pets.
Acceptance of contract: The contract is initiated by acceptance of these terms and conditions and the sending of the booking request. The contract and reservation becomes effective when you have paid to us a deposit of 25% of the total rental before the date indicated.

The rental agreement between you and us can not benefit a third party (e.g. sub-letting or transfer of lease) except with our written agreement.
Any violation of this clause may result in immediate termination of the lease and to be considered to have been cancelled by you.
Cancellation by you: If the reservation was made through an agent such as HomeAway or TripAdvisor, cancellations must be made according to the rules and policies stated on their website, otherwise cancellations must be notified to us by recorded letter.
a) For reservations made directly with us and the cancellation is before arrival at the property: The deposit is forfeited to us and we may request the remaining amount for the stay if the cancellation occurs less than 30 days before the scheduled date of arrival. If you do not arrive within 24 hours of the arrival date indicated on the contract, the contract becomes void and we may rent the accommodation to another tenant. The deposit is forfeited to us and we may request the remaining amount for the stay.
b) If the stay is cut short, no refund will be given.
Cancellation by us: We will refund all monies paid, and if the cancellation is less than 30 days before the scheduled date of arrival, an allowance equal to 50% of the gîte rental price. We will also try to find you alternative accommodation in the area.
Length of stay: The contract is for a fixed period and you may in no circumstances invoke any right to tenure at the end of the stay.
Capacity: The contract is for a specified number of bedrooms and a maximum number of tenants and pets. If the number exceeds the capacity stated on the contract, the owner can refuse the additional people (or pets) or make you leave the accommodation before the end of the rental period. If this happens it will be treated as if you have cancelled the rental. If more bedrooms have been used than you agreed to and a discount given for reduced usage, the owner will recoup (from the damage deposit) the difference between the discounted and full price.
Arrival: You must arrive on the day and time stated on the contract and you must notify us of any late arrival.
Settlement of the balance: The balance of the rent is to be paid on arrival. Please note that this is for tenants paying in cash (Euros) or with Chèques-Vacances or with a cheque for a French bank account. Payments by all other methods must be made at least 30 days before arrival.
Damage/Security deposit: When you arrive, a security deposit of the amount indicated in the contract will be requested by us. On the day of departure the accommodation is inspected and the deposit is returned to you after deduction of any repair or cleaning costs necessary to restore the accommodation to the state it was in on arrival.
If it is not possible to determine the cost of repair at the time of departure or in the event of early departure (before 9 a.m.) preventing the inspection to be carried out, the security deposit (minus any deductions) will be returned by us within 2 weeks.
Your Responsibilities: You must respect the tranquillity and nature of the accommodation and its surroundings with no loud noise between 2 a.m. and 9 a.m.
You must leave the property in the same state of repair and cleanliness in which you found it, otherwise we can deduct an additional charge (see previous section) for cleaning (which is specified in the fact sheet) and also any charges necessary to make repairs.
For safety reasons, smoking is prohibited inside the gîtes.
Disabling smoke detectors is strictly forbidden and will result in the termination of the rental with no refund or compensation.
Pets are welcome if requested via the booking form (where the cost is displayed). You are responsible for the correct behaviour of your pets and for prompt removal of faeces. All pets must be under control on all shared grounds and in the area surrounding the gîte.
For security and safety reasons young children must not be allowed to wander unaccompanied in the shared grounds of the property.
You are responsible for all damages caused by your acts and it is required that you have insurance to cover these risks.
To enable prompt repair or replacement, please report the damage, breakage or non-functioning of any item as soon as possible.
Our Responsibilities: All descriptions on the website are given in good faith and believed to be correct.
Where a complaint has been made about noise or disturbance originating from our other gîte we will mediate and try to resolve the problem.
We cannot be held responsible for the failure of public utilities such as water, and electricity.
We cannot accept responsibility for losses or damages caused by strikes, fire, storms, floods, airport or ferry closure or any other event beyond our control.
We cannot be held responsible for any injury, death, loss or damage to you personally, your belongings or your vehicles.
The use of the gîte, its grounds and any facilities or equipment supplied is entirely at your own risk.
In the interest of continual improvement we reserve the right to alter any part of the gîte, furniture, or facilities without prior notice.
Complaints: In the unlikely event that you have a complaint we would ask that you discuss it with us as soon as possible to enable a quick resolution. If a resolution cannot be reached, the courts of France shall have jurisdiction. Any complaints made after the rental period will not be taken into consideration.
